"John Tupper was named by uncle Jesse after Captain Tupper, with whom he was a great friend, they being brother officers in the war of 1812.

John Tupper (most everybody called him Tupper when I lived among my people in old Fairfield) was never married. He was a (musician) soldier in the war of 1861-5, and lived to be an old man; and there are many living now who knew him from their youth. I recently heard of his last celebration of the Fourth of July. When the boys came out at the break of day shooting their cannon, he came out, old and decrepit as he was, and lustily played his fife, to the great pleasure of himself and all others who gathered round, especially so was it to the younger generation." 1923 - Emporia, Kansas, Nov. 30 - Undersheriff John Austin of Lyon county shot and probably fatally wounded Ray H. Foor, of Covington, Kentucky, on a Santa Fe train in Emporia today after city and county police had fought with Foor on a crowded passenger coach. Foor was a fugitive from the Wichita police who were searching for him after he had shot and seriously wounded R. C. Scudder, a patrolman. Undersheriff Austin was returning from Garden City with a prisoner when Foor boarded the train at Newton. At Florence the conductor received a telegram from Wichita police and Austin moved forward in the coach and sat beside the fugitive. When Lion county and city officers boarded the train at Emporia, Foor opened fire. His bullets went wild and Austin shot him in the left lung. Foor turned his weapon on himself and fired. 1923 - SAYS FOOR WAS DRUNK - Wounded Man's Brother Probes Wichita Tragedy. Ray Foor Is Said To Have Been Drinking Two Days Before He Shot Policeman. Ray H. Foor [bleached out image] slayer of a Wichita policeman probably was under the influence of liquor when he shot the officer at a dance hall the night before Thanksgiving according to Foor's brother, A. C. Foor of Covington, Ky., who returned last night from Wichita where he investigated the case. It is said Foor had been drinking corn liquor and had been intoxicated nearly two days. A. C. Foor has hired Sam Amidon, of Wichita to handle his brother's case. A. L. Foor, father of Ray Foor, father of Ray Foor, arrived in Emporia last night from his home in Frankfort, Ind., and went directly to the hospital to visit his son. The father visited his son again this afternoon. "I want you to know he was a fine boy and never had been known to drink or gamble", the father said. "He has worked hard and had a good job. I can't understand what was the matter in Wichita but something surely was wrong. I am broken up over it." The young man's father knew nothing of the shooting until he arrived in Emporia. Ray Foor has not been told that his brother investigated the shooting in Wichita. He believes his brother went to Wichita on business for the Mosier Safe and Lock company for which the brothers worked. Ray Foor's condition was improved today and he probably will recover. He is still weak but is gaining strength daily. The Wichita Beacon last night printed the following story about Foor under a Convington, KY., dateline: How a young man of excellent habits and regular attendant at Sunday school and church in his own community all his life could turn desperado in another state is a question which friends of Raymond H. Foor, age 21, are puzzling over. They never were more shocked in their lives than when they read in a local newspaper last Thursday morning that Foor had shot a policeman at Wichita. Foor held a position of great trust with the Mosier Safe and Lock company of Covington, and by his employers he was considered one of the best lock experts in the country, regardless of his youth. No one ever knew Foor to take a drink at home, and none even suspected that he ever did. He went to dances but usually remained in the background. He was self-conscious. He was looked upon as a fine young man with a future. And so it is not to be wondered at that Covington was shocked by the tragedy of which Foor was the central figure in Kansas early Thanksgiving morning. [Emporia Gazette, Dec. 5, 1923, p 1]

LOCATION: 1923 - Type of crime: Disturbance. Type of death: Gunshot. The location was Yoemen Dance Hall at 414 1/2 E. Douglas Ave. "Officer [Robert C.] Scudder was responding to a disturbance call [Nov. 27th, 1923] at a dance hall. Proceeding up the stairs he met Ray Foor whom he halted and attempted to body search. The suspect fired, wounding Scudder, and then fled. Another officer followed in pursuit. Officer Scudder died three days later of his wound." [www.wichita.gov - "Wichita Police Department Police Memorial, 'Serving With Honor', 'In Memoriam to Those Officers Who Made the Supreme Sacrifice'", August 2003]

LOCATION: 1924 - Defeats Death, Law Clutches - Slayers Battle to Recover Wins Town. EMPORIA, Kan., Jan. 5 -- When Ray H. Foor, young lock expert from Covington, KY, regains his strength [caused?] by two pistol wounds received in a fight with Emporia police, he will be taken to Wichita to face a charge of first degree murder. Foor is charged with slaying R. C. Scudder, a Wichita policeman, at a dance hall. The wounded man is in the Emporia hospital winning a fight against death the he may fight for his liberty in the Sedgwick County court. Foor's case is not only unusual but tragic. A master workman of steady habits, without blemish on his character, was Ray Foor when he came into Kansas inspecting safe locks for his company at Covington. At Wichita, after he had done his work, he went to a dance hall. There he got into an altercation with a dancer and was ordered off the floor by the manager, who said he had been disorderly. At the door of the hall Foor met Scudder, who started to arrest him. Foor fired his pistol at the patrolman, fatally wounding him. Horrified at what he had done, Foor rushed to his hotel, checked out and caught and interurban train to Newton, where he boarded a Santa Fe train, eastbound. At Emporia officers on the lookout for Foor ented the train coach. Foor fired on thema nd one of the officers sent a bullet into the young man's breast. Seeing escape impossible, Foor turned his pistol on himself, pulled the trigger and fell to the floor, dangerously but not mortally wounded. But there is another side of the story. Upon receipt of the news of the Wichita shooting, Foor's brother, also a lock expert, rushed from Covington to Emporia. At Wichita he talked with persons at the dance and he came back to Emporia convinced that his brother did not shoot Sudder "with malce aforethought" as the charge of murder usually reads. He says his brother, ordinarily sober and of good habits, imbibed too freely of corn whiskey when he went to the dance hall. Foor's anger was aroused when he was ordered off the floor. When he encountered the patrolman at the doorstep he remembered he had a pistol and recalled that carrying concealed weapons was against the law. Jerking the weapon out of his hand Foor says he tried to hand it to a stranger behind him, but the stranger refused to take it. Then the patrolman closed in on Foor and the fatal shot the boy from a life term in prison [this doesn't make sense, but it is how it is worded]. The young lock expert has employed a prominent Wichita lawyer to defend him and the Foors, who are among the Convington's best citizens, will do all in their power to save [found?] in the smouldering ruins of [sentence stops]. The people of Emporia have followed Foor's case carefully. They and especially those who have come in contact with him and his brother and his father, who arrived several days ago, are sympathetic toward the young man, who in an unguarded moment, committed a deed which may cost him his life's liberty. - [The Port Arthur News, Port Arthur, TX; Jan. 6, 1924]

1926 - Marriage license, Jackson Co., MO; Raymond H. Foor of Covington, Kenton Co., KY and Averill Gay of Wichita, Sedgwick Co., KS, (he 25, she 22), license dated March 16, 1926.

LOCATION: 1926 - "When Ray H. Foor, below, entered the Kansas state prison for a two-year term for manslaughter, Miss Averill Gay (above) of Wichita was the only one who went to bid him goodby. During his imprisonment they corresponded, and when he came out she was waiting for him. Now they're married." [Decatur Review, Decatur, IL, March 26, 1926, p 9. Sketches of individuals]

LOCATION: 1926 - Ray H. Foor is "one in a million" in the eyes of Averill Gay, now Foor's wife, and only one of hundreds in the eyes of the average citizen. For today, Ray Foor is trying to "[beat?] back,", he says. "I owe it to my little girl", he smiles. "She waited for me while I served my penitntiary sentence and now I am going to try to do right by her". The romance, unique in it's inception and culmination in marriage, began three years ago when Foor lay at the point of death in his hospital cell in an Emporia, Kansas hospital, here he had been captured following the fatal shooting of a policeman in a brawl in a Wichita, Kansas, dance hall. Miss Gay, one of many who called [tear] on Foor, brought flowers to the wounded man and it was Miss Gay that Foor was most attached and most grateful. And so it was when Foor was sentenced to serve two years in the Kansas penitentiary at Lansing that miss Gay told him, "I'll wait". Thus as the weeks and months rolled by the two kept up their friendship through correspondence, and the hour for Four's [tear] he wrote "I love you dearly, Averill, and I want you to be my wife on the day I am freed". An hour after Miss Gay had read Foor's letter, she had telegraphed her consent to marriage. A few days everything was in readiness. Miss Gay came to Kansas City to await the arrival of Foor from the penitentiary on the day of his release. Foor lost no time. Released at a.m., he rushed for an interurban car, was in Kansas City in another hour, and an hour later had purchased his wedding togs and rings and a mrriage license and was married by a justice of the peace. MIDDLE NAME: From Charlotte Hesselbrock via August 2001 email.

"To Samuel and Nancy Kramer there came first the addition of a daughter, who
was welcomed and greeted as a harbinger of future happiness. She was named
Sarah Eleanora; was pretty, intelligent, and precocious, quick to learn and
devoted, even as a child, to her parents and later, to her brothers and
sisters. Four years later came another little girl who was named Harriet
Loraine, partly in honor of her Aunt Harriet Bumbarger. To her friends she
was Hattie. Then after the passage of another two years, a third daughter
came to brighten the Kramer home, and she surely did brighten it with love
and cheerfulness. She was given the name of Elizabeth Irene, partly in honor
of her Aunt Elizabeth (Bumbarger) Edwards." "THE VILLAGE. MEMORIES OF
LITHOPOLIS", John Bartram Kramer, August 1936, p 22.

"Eleanora was, as a child, sober and studious, delighting in books, loving the society of others, and equally at home with children and her elders. When but thirteen years of age she organized and taught a subscription school for small children". "THE VILLAGE. MEMORIES OF LITHOPOLIS", John Bartram Kramer, August 1936, p 22.

[21369] "Town Inherits 2.5 Million" - Ohio Hamlet of 300 Benefits in Will of N.J. Woman. NEW YORK - The sum which the hamlet of Lithopolis, Ohio, (population 300) will receive under the will of Mrs. Mabel Wagnalls Jones, author and pianist, was set at $2,565.788 when a tax appraisal of her estate was filed. Mrs. Jones who lived at 1 Lexington Avenue and died March 22, 1946, was the widow of Richard J. Jones, investment broker, and daughter of the late Adam Willis Wagnalls, a founder of the Funk & Wagnalls Company, publishers. Her father was a native of Lithopolis. She left the residue of her estate to the Wagnalls Memorial for a community center in Lithopolis, for scholarships for youth of the village and for advancement of the hamlet's cultural life. Mrs. Wagnalls built the memorial in 1925 in memory of her father at a cost of $500,000. Her gross estate was set at $3,027.506 and the net estate at $2,780,788. She left bequests of $40,000 each to five cousins." [The BERKSHIRE EVENING EAGLE, Pittsfield, Berkshire, Massachusetts, April 22, 1948, p 3.]

"Two of the six graduates have already qualified fully for the scholarships... Miss Marilyn Good, 17, will go to Otterbein College, at Westerville, to study primary-school teaching and the pipe organ. Donald Speakman, 18, will go to Ohio State University, at Columbus, to study agriculture. Both come from farm homes." [The BERKSHIRE EVENING EAGLE, Pittsfield, Berkshire, Massachusetts, July 26, 1948, p 7.]

"The donor of the Lithopolis Memorial, Mabel Wagnalls-Jones and her husband, Richard J. Jones are in the village. The Sarcophagus which they are building in the Lithopolis Cemetery is nearing completion and they expect to remain until it is finished. The Sunday sacred concerts each Sunday after noon from 3 to 5 p.m. are still attracting from five to six hundred people in the Memorial building. [Lancaster Daily Eagle, Lancaster, Ohio, Sept. 16, 1927]

", Abbie, 23y b OH

NOTE: The following biography shows she was born in 1871 which is an obvious error as she shows up in the 1870 census with parents.

WAGNALLS, Mabel, musician and author, was born in Kansas City, Mo., April 20, 1871; daughter of Adam Willis and Anna (Willis) Wagnalls; granddaughter of Christopher and Elizabeth (Snyder) Wagenhals and of Aaron and Mary (Henry) Willis, and a descendant of William Henry, only brother of Patrick Henry of Virginia. Her father was one of the original founders of Funk & Wagnalls Co., publishers of the" Standard Dictionary." She was educated under her mother's tuition until 1885, when she studied music in Paris and Vienna, and under Franz Kûllak in Berlin. She made her appearance as piano soloist at the Sing Akademie of Berlin in 1889, and her American début with the orchestra of Theodore Thomas in New York city, Jan. 11, 1891. She also played with Anton Seid's orchestra in 1892, at the New York State Music Teachers' convention at Binghamton, 1897, and at other concerts. She is the author of: Miserere (1892); Stars of the Opera (1898); Selma the Soprano (1898), and of several contributions on musical subjects to leading publications. Ancestry.com. [26291] NOTE: Place of birth on this Warren family is suspect. I found them in 1850
and their two children are shown as being born in Ohio. According to the
1860 and subsequent census's, the children born after 1850 -- as late as 1858
-- were supposedly born in Canada. According to the census info, we're to
assume that they resided in Ohio in 1850, went to Canada within two years and
had 3 children born there but returned to Ohio by 1860.
